The term “Limited Tort” refers to a type of automobile insurance in the state of Pennsylvania. Pennsylvania state law mandates that drivers choose between two types of auto insurance: Limited Tort and Full Tort. Full Tort auto insurance allows the insured party and his/her family to sue the responsible party in an automobile accident without restriction.
Limited Tort auto insurance has lower premiums, but significantly reduces one’s ability to sue the responsible party in an automobile accident. With Limited Tort insurance, you cannot bring a claim for “pain and suffering” unless someone has died, suffered serious scarring or disfigurement, or sustained a “serious injury” (as defined by law ) in an automobile accident.
